La reforma constitucional

Abstract

El presente trabajo tiene por objeto el estudio sistemático de la reforma constitucional en España, analizando su evolución histórica, antecedentes, configuración, procedimiento y las dificultades estructurales y políticas que condicionan su aplicación práctica. Para ello, se parte de un recorrido histórico por los mecanismos de reforma previstos con el fin de contextualizar el modelo actual y comprender su grado de rigidez y estabilidad normativa. Posteriormente se expone el procedimiento actual de reforma previsto en la Constitución, las reformas operadas y las iniciativas que no prosperaron. Se reflexiona sobre los obstáculos estructurales que inciden en la operatividad del poder de reforma y sobre el equilibrio entre estabilidad constitucional y adaptación a los cambios sociales, económicos y políticos.

The present work aims to carry out a systematic study of constitutional reform in Spain, analyzing its historical evolution, background, configuration, procedure, and the structural and political difficulties that condition its practical application. To this end, it begins with a historical overview of the reform mechanisms provided for in order to contextualize the current model and understand its degree of rigidity and normative stability. Subsequently, the current reform procedure established in the Constitution, the reforms that have been carried out, and the initiatives that did not succeed are presented. The paper reflects on the structural obstacles affecting the operability of the reforming power and on the balance between constitutional stability and adaptation to social, economic, and political changes.
