Responsabilidad de los usuarios de vehículos de movilidad personal

Abstract

La utilización de Vehículos de Movilidad Personal (VMP) en las vías urbanas ha aumentado drásticamente durante la última década. No obstante, la normativa no ha avanzado de forma simultánea, existiendo vacíos legales que han producido inseguridad jurídica tanto a los conductores de estos vehículos como al resto de usuarios de la vía. Actualmente, existe más regulación sobre los mismos, pero se encuentra diversificada a nivel europeo, estatal y local. Por este motivo, surge la idea de confeccionar el presente trabajo con el fin de unificar la normativa aplicable a los VMP y de analizar la posible responsabilidad administrativa, penal y civil que puede conllevar su uso.

The use of Personal Mobility Vehicles (PMV) on urban roads has increased dramatically over the past decade. However, legislation has not progressed at the same pace, resulting in legal gaps that have created legal uncertainty for both the drivers of these vehicles and other road users. Currently, there is more regulation in place, but it is fragmented at the european, national and local levels. For this reason, the idea of preparing this paper arose, with the aim of unifying the applicable regulations for PMV and analyzing the potential administrative, criminal and civil liability that their use may entail.
