El Defensor del Pueblo en España

Abstract

Profundizamos en la figura del Defensor del Pueblo en España, para llegar a comprender las responsabilidades, tareas o las labores encomendadas a esta Institución que se podría decir que es autónoma, e independiente. Pondremos en relieve y cuestionaremos, para con ello poder valorar su eficacia. Este trabajo abordará su evolución desde sus orígenes, situándonos desde la raíz de su aparición, dónde fue el comienzo de la institución, y así hasta llegar a su momento actual. Analizaremos su marco normativo, su trabajo y la importancia del mismo para la defensa de los Derechos Fundamentales, la relevancia social y los retos, al igual que las amenazas que se plantean hoy en día. A través de este citado trabajo, se va a procurar averiguar la importancia de esta Institución, las garantías que nos aporta por su defensa del Estado de Derecho, advertir sus disfunciones, y proponer mejoras para optimizar su labor y evolución, tanto en la relación con la ciudadanía como con las demás instituciones.

We delve into the figure of the Ombudsman in Spain to understand the responsibilities, tasks, and duties assigned to this institution, which can be considered autonomous and independent. We will highlight and question its role to assess its effectiveness. This work will address its evolution from its origins, tracing back to the root of its establishment, identifying where the institution began, and following its development up to the present day. We will analyze its regulatory framework, its operations, and its significance in defending Fundamental Rights, as well as its social relevance, challenges, and the threats it faces today. Through this study, we aim to determine the importance of this institution, the guarantees it provides in defending the Rule of Law, identify its dysfunctions, and propose improvements to optimize its work and evolution both in its relationship with citizens and other institutions.
