El decadente desarrollo constitucional en Latinoamérica frente al espléndido marco constitucional español

Abstract

En este trabajo se desarrollará brevemente las situaciones más relevantes en las cuales se han lesionado gravemente las normas supremas de varios estados, en diferentes momentos del siglo XX y XXI, tales como: Ecuador, Perú, Cuba, Nicaragua y Venezuela. Además, se realizará un análisis comparativo de la constitución española de 1978 en relación a las constituciones de los países mencionados, para, así, posteriormente, ofrecer soluciones adecuadas sobre: dar respuesta al ¿Por qué hay tantos problemas sociales y políticos en los Estados latinoamericanos?; poder reducir la violación a los derechos fundamentales recogidos en las diferentes Constituciones; realizar posibles ajustes en la norma jurídica principal para un mejor funcionamiento tanto social como político y ofrecer sugerencias para una correcta separación de poderes. Todo esto tomando como referencia el Estado democrático-social español y la Constitución Española de 1978. Asimismo, se propone varias soluciones a ámbitos importantes de la Constitución Española: una mejora en el principio de igualdad. Una igualdad efectiva entre hombres y mujeres; un cambio en el modelo de descentralización política, propuesta de un Estado Federal; y una reforma en la sucesión de la corona para hacer efectivo el principio de igualdad que propugna la Constitución Española. En conclusión, todo este trabajo se hará usando una metodología de: investigación documental, recopilando los datos más relevantes ajustados a cada caso; investigación cualitativa, expresando las situaciones sociales y opiniones producidas por el no respeto a las normas constitucionales; y un análisis comparativo entre las diversas Constituciones y la de España.

This paper will briefly examine the most relevant situations in which the supreme norms of various states have been seriously violated at different points throughout the 20th and 21st centuries, in countries such as Ecuador, Peru, Cuba, Nicaragua, and Venezuela. In addition, a comparative analysis will be carried out between the Spanish Constitution of 1978 and the constitutions of the countries. The aim is to subsequently offer appropriate solutions to key questions such as: Why are there so many social and political problems in Latin American states? How can the violation of fundamental rights enshrined in various constitutions be reduced? What possible adjustments can be made to the main legal norm to improve both social and political functioning? Furthermore, suggestions will be offered for ensuring a proper separation of powers. All of this will be done using the Spanish social-democratic state and the 1978 Spanish Constitution as a reference. Likewise, several proposals will be made regarding important aspects of the Spanish Constitution: improvement of the principle of equality, specifically the effective equality between men and women; a change in the model of political decentralization, proposing a federal state; and a reform of the rules of succession to the crown in order to fully implement the principle of equality advocated by the Spanish Constitution. In conclusion, this entire project will be carried out using the following methodology: documentary research, collecting the most relevant data specific to each case; qualitative research, expressing the social situations and public opinions that arise from the failure to uphold constitutional norms; and a comparative analysis between the various constitutions and that of Spain.
