La adopción internacional en el derecho internacional privado español. Evolución normativa

Abstract

El propósito de este trabajo es analizar la evolución normativa de la adopción internacional en el Derecho Internacional Privado español, teniendo en consideración que en las adopciones internacionales intervienen, al menos, dos ordenamientos jurídicos distintos: las normas del país de origen del adoptado y las normas del adoptante. Al efecto, se estudian los distintos tratados y convenios internacionales, así como la normativa española con especial énfasis en el papel de la jurisprudencia.

The purpose of this work is to analyze the regulatory evolution of international adoption in Spanish Private International Law, taking into consideration that at least two different legal systems intervene in international adoptions: the regulations of the country of origin of the adoptee and the regulations of the adopter. To this end, the different international treaties and conventions are studied, as well as Spanish regulations with special emphasis on the role of jurisprudence.
