At the present Undergraduate Dissertation, an exhaustive study of the regulatory and
jurisprudential framework regulating unfair competition in Spanish law is conducted,
emphasizing the legislative evolution and significant reforms that have influenced the
protection of free competition and consumer rights. This study begins with a historical review
of Spanish competition legislation, from the enactment of Council Regulation No. 17 of
February 6, 1962, to contemporary laws such as Law 15/2007, on the Defense of Competition, incorporating how European Community regulations have influenced Spanish
legislation.
The study addresses in detail Law 3/1991, of January 10, on Unfair Competition and its
subsequent amendment by Law 29/2009, which modified the legal regime to adapt to
European directives and enhance consumer protection. The various acts considered unfair
under this law are analyzed, as well as unfair commercial practices and consumer rights,
offering a perspective on how these elements have been established in a legal framework that
seeks to balance competition in the market.
Finally, the project concludes with a jurisprudential analysis that delves into the decisions of
Spanish courts regarding specific cases of unfair competition. This segment is crucial for
understanding how the law is applied in practice and what the trends are in the judicial
interpretation of acts of unfair competition. Relevant judgments which have shaped the
application of the law are examined, highlighting the importance of these decisions in
shaping the current legal environment. This comprehensive approach not only provides a
theoretical view of the subject but also highlights its practical relevance and the need for a
consolidated legal framework that can adapt to the modern market.
