Los patinetes eléctricos y su responsabilidad civil

Abstract

El cambio de paradigma que ha supuesto la aparición y el creciente uso de los patinetes eléctricos en el ámbito de la seguridad vial y la circulación de vehículos ha puesto de manifiesto la necesidad de adaptar la normativa existente y regular las nuevas situaciones jurídicas derivadas de su utilización. No obstante ello, nos encontramos todavía con ciertas dudas acerca de la conceptualización jurídica del patinete eléctrico, de sus posibilidades en la circulación vial y con cierta incertidumbre sobre la cobertura legal con que cuentan estos recientes medios de transporte. Partiendo de este contexto y teniendo en cuenta el área jurídica en la que nos movemos, el Derecho Civil, pretendemos dar cuenta en el presente trabajo del concepto y características principales de esta tipología de vehículo de movilidad personal, de su normativa reguladora, de la problemática asociada a su uso y de la responsabilidad civil derivada de las situaciones con relevancia jurídica en las que esté implicado un patinete eléctrico.

The paradigm shift brought about by the appearance and growing use of electric scooters in the field of road safety and vehicle circulation has highlighted the need to adapt existing regulations and regulate new legal situations arising from their use. Despite this, we still find ourselves with certain doubts about the legal conceptualization of the electric scooter, its possibilities in road traffic and with certain uncertainty about the legal coverage that theses recent means of transportation have. Starting from this context and taking into account the legal area in which we operate, Civil Law, we intend to give an account in this work of the concept and main characteristics of this type of personal mobility vehicle, its regulatory regulations, the problematic associated with its use and the civil liability derived from situations with legal relevance in which an electric scooter is involved.
