Instrucciones previas en el ámbito sanitario, menores de edad y personas con discapacidad

Abstract

En el ámbito de las instrucciones previas, la parquedad de la Ley 41/2002, de 14 de noviembre, unida a la disparidad de criterios incluidos en las normativas autonómicas, generan muchas dudas interpretativas. A este respecto, consideramos que es necesario que el legislador estatal establezca unos mínimos comunes para todo el territorio y defina los contornos de esta institución. Además, entendemos que existen criterios suficientes para matizar la cuestión relativa a los sujetos legitimados y, en particular, por lo que se refiere a la aparente exclusión de los menores de edad y de las personas con discapacidad

in the field of advance directives, the sparsity of Law 41/2002 of 14 November, together with the disparity of criteria included in the regional regulations, generate many interpretative doubts. In this regard, we believe that it is necessary for the state legislature to establish typical minimums for the entire territory and to define the contours of this institution. In addition, we believe that there are sufficient criteria to clarify the issue of legitimate subjects and, in particular, with regard to the apparent exclusion of minors and persons with disabilities
