Marco jurídico europeo en extranjería: Verdades y retos desde el punto de vista del fenómeno de los MENAS

Abstract

El objetivo del presente trabajo es analizar la situación migratoria en Europa y España, en cuanto a los Menores No Acompañados (MENA), los problemas migratorios que se han generado ante esta situación y las leyes nacionales e internacionales que se han emitido con respecto a este tema en marco de los derechos humanos fundamentales que tienen los niños y adolescentes. Esto se logró a través de una revisión documental de los conceptos, teorías y legislaciones relevantes en el tema, lo que llevó a concluir que existen diversas situaciones y marcos jurídicos que permiten tratar el complicado panorama de la inmigración de menores no acompañados en el continente, por lo que cada estado debe emanar leyes especiales que atiendan y ayuden a regularizar la situación de estos niños.

The objective of this work is to analyze the migratory situation in Europe and Spain, in terms of Unaccompanied Minors (MENA), the migratory problems that have been generated in this situation and the national and international laws that have been issued with respect to this. issue within the framework of the fundamental human rights of children and adolescents. This was achieved through a documentary review of the relevant concepts, theories and legislation on the subject, which led to the conclusion that there are various situations and legal frameworks that allow dealing with the complicated panorama of immigration of unaccompanied minors in the continent. Therefore, each state must enact special laws that attend to and help regularize the situation of these children.
