Policía Local como Policía Judicial

Abstract

El presente trabajo tiene como objetivo analizar el sistema de Policía Judicial vigente en España desde el prisma de los Cuerpos de Policía Local dependientes de los Ayuntamientos. Para ello se ha partido de un estudio del diseño del modelo policial español, con idénticos niveles que el resto de la Administración Pública, estatal, autonómica, con grandes diferencias entre las distintas Comunidades Autónomas según el marco competencial establecido en sus distintos Estatutos, y local, pese a no existir estos Cuerpos en todos los Ayuntamientos de España, exponiendo las distintas competencias que sobre ellos tienen la administración Estatal y Autonómica. Continúa el trabajo con un análisis de la evolución de las Policías Locales para pasar, una vez conocidas las capacidades de estos Cuerpos, a definir los distintos conceptos jurídicos vigentes en el ordenamiento jurídico español sobre Policía Judicial del mas general y amplio al más específico y restrictivo, distinguiendo entre funciones de Policía Judicial y Unidades Orgánicas de Policía Judicial que con un marco normativo dependen funcionalmente de Jueces y Fiscales de forma permanente. Le sigue un análisis del actual funcionamiento de las Policías Locales desarrollando funciones de Policía Judicial, así como de la posibilidad de creación de Unidades Orgánicas de Policía Judicial en estos Cuerpos, tratando algunas de las ya constituidas. Una visión de las posibilidades de futuro sobre estas funciones y Unidades de Policía Judicial finalizan el trabajo que se cierra con las correspondientes conclusiones.

This paper aims to analyze the Judicial Police system in force in Spain from the prism of the Local Police Forces dependent on the City Councils. For this, it has been based on a study of the design of the Spanish police model, with identical levels as the rest of the Public Administration, state, autonomic, with great differences between the different Autonomous Communities according to the competence framework established in its different Statutes, and local, despite not existing these Bodies in all the City Councils of Spain, exposing the different competences that the State and Autonomous Administration have over them. The work continues with an analysis of the evolution of the Local Police to pass, once the capacities of these Bodies are known, to define the different legal concepts in force in the Spanish legal system on Judicial Police from the most general and broad to the most specific and restrictive, distinguishing between functions of Judicial Police and Organic Units of Judicial Police that with a regulatory framework depend functionally on Judges and Prosecutors permanently. It is followed by an analysis of the current functioning of the Local Police developing functions of Judicial Police, as well as the possibility of creating Organic Units of Judicial Police in these Bodies, dealing with some of those already constituted. A vision of the future possibilities on these functions and Judicial Police Units ends the work that closes with the corresponding conclusions.
