Marco jurídico para la resolución del problema de los menores no acompañados en España

Abstract

La sociedad evoluciona, las necesidades cambian, y las formas de afrontar las diversas realidades que se nos presentan también lo hacen. Siendo esto así, no necesariamente todo lo novedoso no tiene por qué ser mejor. El querer evolucionar hacia un futuro cuanto menos incierto, provoca numerosas situaciones de injusticia, casi todas ellas marcadas por factores económicos y sociales. Es en este punto en el que debemos destacar la importancia que tiene la sociedad a la hora de contribuir en ese cambio. Las personas son el elemento fundamental al que debemos acudir para propiciar ese desarrollo buscado por las grandes sociedades. El mal uso que se hace de las personas genera situaciones que degradan la integridad moral y en ocasiones física de colectivos tan vulnerables como es el de los menores de edad. Aquí destacamos la figura de los Menores Extranjeros no Acompañados (MENAS), aquellos menores procedentes normalmente de países subdesarrollados que buscan una nueva vida en nuestro país. El hecho de estar solos puede ocasionarles situaciones muy desagradables, ya que, por esa misma razón, van a tener que enfrentarse a situaciones difíciles y complejas ante las que nos siempre van a saber cómo actuar. A lo largo del trabajo expondremos las diversas realidades a las que se enfrentan los MENAS diariamente, las circunstancias que motivan su desplazamiento, la gran cantidad de problemas que pueden llegar a tener, así como las medidas de protección a las que podrán ser sometidos dependiendo de su situación, siempre tomando las decisiones en vista del Interés Superior del Menor.

Society evolves, needs change, and the ways of facing the various realities presented to us also do so. This being so, not necessarily everything new has to be better. The fact of wanting this evolution carried by uncertainty, provoques a vast number of injustices, the major part of them marked by economic and social facts. In this point we must highlight the importance of society at the moment of contributing to this change. People are the principal component we may use when it comes to promote the developement wanted by big societies. The wrong use societies make about people, degrade the moral integrity and, even tho the physical one from vulnerable colectives like children. Here we highlight the figure of Non Accompanied Foreign Minors, those coming from underdeveloped countries looking for a new life in our country. The fact of being alone cause them unpleasant situations, and for that reason they are going to go through difficult situations at the sight of they will not know how to act everytime. Over the project, I will expose the diverse realitites that Non Accompanied Foreign Minors stand daily, the circumstances that motivate their shift, and of course the grand quantity of problems they can get to have, remarking the protective measures they can achieve depending on their situation, taking always into account the Major Interest of Children.
