Responsabilidad civil de las residencias privadas de mayores por las muertes sucedidas en la pandemia por Covid 19

Abstract

Durante esta pandemia, el mayor número de víctimas por fallecimiento de covid se ha dado en las residencias de mayores, ya fuesen públicas o privadas. Este elevado número de afectados se ha dado por múltiples causas. Tanto los perjudicados como sus familiares tienen derecho a que les resarzan por los daños físicos y morales que les han producido. En el desarrollo de este trabajo, se hace una valoración de la situación y se observan cuáles han sido los principales daños y las causas, con el objetivo de demostrar en qué tipo de responsabilidad han incurrido y, por lo tanto, el derecho que tienen los afectados a recibir una a indemnización.

During this pandemic, the highest number of victims, by death of covid, has occurred in nursing homes, whether public or private. This high number of victims has been due to multiple causes. However, both the victims and their relatives are entitled to compensation for the physical and moral damages they have suffered. In the development of this report, an assessment of the situation is made, the main damages and the causes are observed, with the aim of demonstrating what type of liability has been incurred and therefore the right of those affected to receive compensation.
