Criminalidad en menores en la Comunidad Valenciana

Abstract

La criminalidad en menores en la Comunidad Valenciana se ha convertido en un asunto delicado de tratar desde la aprobación en el año 2000 de la Ley Orgánica de Responsabilidad Penal del Menor (LORPM). La permisividad de esta ley hacia los menores ha hecho que se refleje que éstos tienen total impunidad cuando lo que se pretende es no tratarlos como a criminales y reconducir su conducta a través de medidas educativas que les sirvan para reformarse. El objetivo de este trabajo es reflejar el efecto de la Ley en la criminalidad de los menores durante estos años y ver la evolución que ha tenido, así como las diferencias en las tendencias de la comisión de delitos entre menores a lo largo del tiempo y su tratamiento penal. También se diferenciará por género, nacionalidad y grupos de edad (dentro de la minoría) de la comisión de los delitos para derribar algunos tabúes vertidos y propagados desde el odio de algunos medios y partidos políticos. Los casos de Shila Bigdely y Maikel ayudarán a mostrar como ha evolucionado el tratamiento a los menores durante estos 20 años, tanto penalmente como a través de los medios, y ejemplificarán las diferencias judiciales entre menores y adultos, y el auge en estos de la violencia sexual entre los delitos cometidos por menores en la Comunidad Valenciana. Como conclusión se recogerán las claves que resumirán todo lo expuesto en esta investigación.

Criminality in minors in the Valencian Community has become a delicate matter to deal with since the approval in 2000 of the Organic Law of Criminal Responsibility of Minors (LORPM). The permissiveness of this law towards minors has reflected that they have total impunity when what is intended is not to treat them as criminals and redirect their behavior through educational measures that help them reform. The objective of this work is to reflect the effect of the Law on the criminality of minors during these years and to see the evolution that it has had, as well as the differences in the trends of the commission of crimes among minors over time and their criminal treatment. It will also be differentiated by gender, nationality and age groups (within the minority) of the commission of crimes to break down some taboos spilled and propagated from the hatred of some media and political parties. The cases of Shila Bigdely and Maikel will help us show how the treatment of minors has evolved during these 20 years, both criminally and through the media, and will exemplify the judicial differences between minors and adults, and the boom in these of sexual violence among crimes committed by minors in the Valencian Community. As a conclusion, the keys will be collected in a short report that will summarize everything exposed in this investigation.
