Estudio de los contratos internacionales de aprovechamiento por turno de bienes de uso turístico, desde la perspectiva del Derecho Internacional Privado Español

Abstract

El propósito de este trabajo es explicar el derecho de aprovechamiento por turnos de bienes de uso turístico encuadrando esta figura en el marco del Derecho internacional privado. Para ello, primeramente se definirá y contextualizará el fenómeno, para seguidamente analizar la normativa derogada y vigente tanto en el marco del Derecho de la Unión Europea como en la Ley española. El trabajo finalizará explicando las principales causas de nulidad de este tipo de contratos y la respuesta por parte de nuestros operadores jurídicos a los conflictos planteados en nuestros tribunales

The purpose of this paper is to explain the right to take turns of goods for tourist use by framing this figure within the private international law framework. This phenomenon will first be defined and contextualized, so that both the repealed and the current regulations can be analyzed in relation to the European Union Law and the Spanish Law framework. This study will sum up by explaining the main causes of invalidity of this type of contract and the response that Spanish legal operators give to the conflicts raised in national courts
