La protección jurídica internacional del patrimonio cultural subacuático: El caso Odyssey

Abstract

Este Trabajo de Fin de Grado deja constancia de la problemática existente sobre el patrimonio cultural subacuático. En el mundo existe una gran multitud de restos arqueológicos sumergidos, por lo que, tanto los organismos internacionales, como los diferentes Estados, intentan dar solución a problemas como; a quién pertenece este patrimonio, qué medidas se pueden tomar para su conservación y protección, y qué hacer para evitar su expolio. Es interesante conocer toda esta problemática a través de un caso concreto como es el caso Odyssey. Estamos ante un caso que tuvo una gran repercusión mediática en España, ya que el gobierno español y la empresa estadounidense Odyssey se embarcaron en un largo proceso judicial que puso en juego el patrimonio cultural español. Se analizará el caso Odyssey desde la perspectiva del Derecho Internacional Privado, haciendo especial hincapié en aquellas situaciones en las que se haya que determinar la competencia judicial internacional y la ley aplicable, a supuestos derivados de la protección jurídica internacional del patrimonio cultural subacuático

This Final degree Project, puts on record the existing problem on underwater cultural heritage. In the world there is a great multitude of submerged remains. For that reason, both the intergovernmental organizations and the different states are trying to give a solution to the problems like; who owns that heritage, what measures can be taken for its conservation and protection, and what to do to prevent its pillage. It is interesting to know all this problem through a specific case like the Odyssey case. It was a case that had a great media impact in Spain, because the Spanish government and the American company were involved in a long judicial process that brought to light the Spanish cultural heritage. The Odyssey case will be analyzed from the perspective of Private International Law, with special emphasis on those situations in which international jurisdiction has to be determined and the law applicable to cases derived from the international legal protection of underwater cultural herit
