El género en la jurisprudencia del Tribunal Constitucional

Abstract

El presente trabajo pretende analizar qué efectos ha tenido la injerencia del concepto género en la jurisprudencia del Tribunal Constitucional a propósito también de la Ley Orgánica 3/2007 para la Igualdad Efectiva entre Mujeres y Hombres. Veremos cómo ha ido haciéndose paso este concepto entre la legislación a lo largo del tiempo y como ha ido influyendo esta “nueva” concepción de género a los tribunales y a la legislación. Analizaremos y estudiaremos como legislador y Tribunal han interactuado y mantenido en este sentido una constante “conversación” a partir de la legislación surgida así como como por los pronunciamientos jurisprudenciales del Tribunal Constitucional y del Supremo

The present work tries to analyze the effects s of the interference that the concept of gender has had in jurisprudence of the Constitutional Court, related to the Ley Orgánica 3/2007 para la Igualdad Efectiva entre Mujeres y Hombres. We will track the concept of gender through legislation over time and we will analyze how this “new” concept has influenced the courts and legislation. Finally, we will analyze and study how the legislator and the Court have interacted and maintained a constant “discussion” base don the emerged legislation as well as the the jurisprudential pronouncements of the Constitutional Court and the Supreme Court on this matter
