Responsabilidad de los centros docentes por los daños causados por alumnos menores de edad en actividades extraescolares

Abstract

El objetivo de este estudio es determinar quién es el responsable sobre los daños ocasionados por los alumnos menores de edad. Principalmente, tenemos en cuenta, las actividades extraescolares y complementarias. Con este estudio pretendemos responder algunas preguntan que suelen surgir cuando un alumno menor de edad provoca un daño, y no sabemos quién es el sujeto que debe responder o, a quién dirigirnos. Para ello, siempre hemos tenido en cuenta a estos tres sujetos, al menor, padres y al centro docente, basándonos en la ley y la jurisprudencia. Para determinar la responsabilidad, también hemos tenido en cuenta diversos aspectos, los cuales se analizan durante el estudio. Uno de los más importantes, la edad del menor, dado que ha sido muy relevante para poder analizar las situaciones habituales conforme al ámbito civil, penal y administrativo

The objective of this study is to determine who is responsible for the damages caused by minor students. Mainly, we consider the extracurricular and complementary activities. With this study we try to answer some questions that usually arise when a minor student causes harm, and we do not know who is the subject to answer or who to contact. For this, we have always taken into account these three subjects, the minor, parents and the educational center, based on law and jurisprudence. To determine responsibility, we have also taken into account various aspects, which are analyzed during the study. One of the most important, the minor's age, given that it has been very relevant in order to analyze the usual situations according to the civil, criminal and administrative sphere
