La custodia y el interés superior del menor

Abstract

El presente trabajo tiene como objeto de estudio el régimen de custodia de los menores de edad no emancipados tras la ruptura del matrimonio o pareja. Interpretando las normas de que regulan la figura en la actualidad y el estudio de su evolución, lo cual ha ido sucediendo a medida que la sociedad ha ido requiriendo que realidad jurídica y las normas que regulan la institución se adapten a la realidad social y personal de los ciudadanos. Teniendo siempre presente el interés superior del menor, el cual es el principal protagonista de esta institución

The present work has as object of study the custody regime of underage emancipated minors after the breakdown of the marriage or couple. Interpreting the norms that regulate the figure at present and the study of its evolution, which has been happening as society has been requiring that the legal reality and the norms that regulate the institution adapt to the social and personal reality of the citizens.
