Las viviendas de uso turístico

Abstract

El objeto de este Trabajo de Fin de Grado es llevar a cabo un análisis acerca de los alojamientos turísticos y su regularización en España, haciendo mayor hincapié en la regulación de la Comunitat Valenciana. De tal forma que este estudio también puede servir como guía práctica y concisa dirigida a todos aquellos prestadores de servicios que quieran iniciarse en la actividad de uso turístico en la CV. Asimismo, en el presente trabajo, se pone de relieve la incidencia que tiene actualmente el uso extendido de las nuevas tecnologías en el sector turístico, fomentando con ello el uso de las plataformas digitales colaborativas, lo que ha permitido un cambio de paradigma en la intermediación turística de los alojamientos vacacionales. Así pues, se expone la modificación legislativa de los alquileres turísticos a partir de su exclusión de la Ley de Arrendamientos Urbanos y se destaca la consecuente disparidad normativa, debida a las distintas regulaciones otorgadas por cada Comunidad Autónoma, las cuales asumen la competencia que les otorga la Constitución Española en materia de promoción y ordenación del turismo. En este sentido, se pone de manifiesto las limitaciones al alquiler turístico empleadas por algunas CCAA y se lleva a cabo una valoración jurídica de tales disposiciones. Posteriormente, se ilustran al detalle los requisitos técnicos de la normativa sectorial de la Comunitat Valenciana. Y, por último, se hace referencia a las problemáticas sociales, económicas y jurídicas que trae consigo el crecimiento de los alojamientos de uso turístico, así como sus posibles soluciones

The goal of the present Project is to conduct an analysis on tourist accommodation and its regularization in Spain, emphasizing particularly the legislation in Comunitat Valenciana. As such, this study can serve as a practical and concise guide to all service providers who intend to initiate their activity for tourist use in CV. In addition, the present work highlights the incidence of the current widespread use of new technologies in the tourism industry, which has favoured the utilisation of collaborative digital platforms and enabled a change of paradigm in the tourist intermediation of vacational accommodation. Therefore, the legislative modification of tourist rentals after its exlcusion from the Law of Urban Rentals is discussed. The subsequent regulatory disparity, arising from the different regulations granted by each Comunidad Autónoma, which undertake the jurisdiction bestowed by the Spanish Constitution with regard to promotion and legislation of tourism, is also stressed. In this sense, the limitations of tourist rentals applied by some CCAA are brought to light and a legal evaluation of such dispositions is performed. Afterwards, the technical requirements of the sectorial legislation in Comunitat Valenciana are illustrated in detail. Finally, the social, economic and legal problems brought about by the growth of tourist accommodations are discussed, as well as their possible solutions
