Abstract:
Este trabajo tiene como objetivo investigar acerca de la promulgación de la primera ley de huelgas en España, tal vez una de las leyes más controvertidas en cuanto a importancia y eficacia se refiere. El derecho de huelga es difícil de encuadrar en un marco legal que, sin necesidad de excesiva intervención, se aplique de forma efectiva. En primer lugar haremos un análisis del contexto socio-político de la época ya que la ley de huelga llega como reacción del gobierno a las contínuas revueltas y conflictos laborales. Estos conflictos llegan a ser tan intensos que los mismos trabajadores presionan al gobierno para que intervenga regulándolos en un marco legal adecuado. Tendremos en cuenta la figura incuestionable de Antonio Maura Montaner como artífice de esta ley hasta llegar a su aprobación, lo cual es el objetivo principal del trabajo. La aplicación de dicha ley nos deja reacciones de todo tipo y un largo camino hasta su aprobación. Supone la regulación de la conflictividad laboral en general y el intento de solución al entonces vigente conflicto socio-laboral entre trabajadores y patronos. Por último analizaremos los obstáculos políticos y vicisitudes que tuvo la génesis de esta ley.
This paper aims to investigate the enactment of the first law on strikes in Spain, perhaps one of the most controversial laws in terms of importance and effectiveness. The right to strike is difficult to fit into a legal framework that, without the need for excessive intervention, is effectively applied. Firstly, we will make an analysis of the socio-political context of the time since the strike law comes as a reaction of the government to the continuous revolts and labor conflicts. These conflicts become so intense that the workers themselves pressure the government to intervene, regulating them within an adequate legal framework. We will take into account the unquestionable figure of Antonio Maura Montaner as the architect of this law until it is approved, which is the main objective of the work. The application of this law leaves us with reactions of all kinds and a long way to its approval. It supposes the regulation of the labor conflict in general and the attempt of solution to the then effective social-labor conflict between workers and employers. Finally, we will analyze the political obstacles and vicissitudes that the genesis of this law had.
