El cambio de nombre y sexo en el Registro Civil y la disforia de género

Abstract

En el presente trabajo se pretende poner de relieve cuáles son las principales cuestiones que se plantean en torno a la identidad personal y sexual, al igual que se examina la correspondiente modificación que ello conlleva en el Registro Civil en personas con disforia de género, haciendo especial hincapié en el caso de los menores de edad y personas con la capacidad judicialmente modificada. Analizaremos cuáles son los requisitos necesarios, así como el procedimiento que se ha de llevar a cabo para su inscripción en el Registro Civil. Todo ello a través de un análisis normativo mediante el cual podremos observar las modificaciones legislativas efectuadas, con especial mención a: la Ley 3/2007, de 15 de marzo, reguladora de la rectificación registral de la mención relativa al sexo de las personas; a la Instrucción de 23 de octubre de 2018 de la DGRN, sobre cambio de nombre en el RC de personas transexuales; así como al Borrador de la Ley para la igualdad real y efectiva de las personas trans. También nos ocuparemos de elaborar un estudio sobre la tramitación de expedientes archivados en el Registro Civil de Elche, durante los últimos 5 años, así como su representación gráfica, simultáneamente trataremos de observar consultas de expedientes emitidos por la DGRN, entre otros. Con todo ello trataremos de hacer una mención sucinta respecto al tema que nos concierne de la disforia de género en otros ordenamientos jurídicos y sus diferencias y semejanzas respecto con el ordenamiento jurídico español.

The aim of this study is to analyze the main issues that arise in relation to personal and sexual identity, as well as to examine the corresponding modification that this entails in the Civil Registry for people with gender dysphoria, with special emphasis on the case of minors and people with judicially modified capacity. We will analyse the necessary requirements, as well as the procedure to be carried out for its registration in the Civil Registry. All this through a normative analysis by means of which we will be able to observe the legislative modifications made, with special mention of: Law 3/2007, of 15 March, regulating the registry rectification of the mention relating to the sex of people; the Instruction of 23 October 2018 of the DGRN, on the change of name in the CR of transsexual people; simultaneously we will try to observe the jurisprudence of the SC and consultations of files of the DGRN; as well as the Draft of the Law for the real and effective equality of trans people. We will also carry out a study on the processing of files archived in the Civil Registry of Elche, during the last 5 years, as well as their graphic representation, and simultaneously we will try to observe consultations of files issued by the DGRN, among others. With all of the above, we will try to make a brief mention of the issue of gender dysphoria in other legal systems and its differences and similarities with respect to the Spanish legal system.
