dc.description.abstractEn el presente trabajo se analizará la responsabilidad civil en el ámbito sanitario, su marco legal y la repercusión que dicha responsabilidad ha ocasionado en la práctica médica, haciendo mención especial a la relación médico-paciente, que da inicio a tal responsabilidad, analizando los posibles bienes jurídicos que se puedan ver lesionados por la misma. Asimismo, en el trabajo se analizarán los requisitos exigidos para que pueda darse una responsabilidad sanitaria, así como la necesaria relación de causalidad entre lesión y actividad sanitaria, donde encontramos elementos clave de esta responsabilidad como lo son la Lex Artis ad hoc, a la que se debe ajustar al actuar de un profesional, analizando la cual podrá verificarse si el daño se hubiera podido evitar. Por último, se planteará cuál es el tratamiento de la responsabilidad civil sanitaria en los ámbitos civil, administrativo y penal, así como también la responsabilidad que tienen las administraciones públicas al respecto, la escasa regulación de la materia y los problemas que ello conlleva a la hora de acudir a los tribunales, haciendo, por último, mención a la incidencia en la responsabilidad a causa de la pandemia provocada por la pandemia SARS-CoV-2.es_ES
dc.description.abstractThis paper will analyse civil liability in the field of healthcare, its legal context and the repercussions that such liability has had on medical practice, making special mention of the doctor-patient relationship, which gives rise to such liability, analysing the possible legal rights that may be harmed by it. The work will also analyse the requirements for health liability, as well as the necessary causal relationship between injury and health activity, where we find essential elements of this liability such as the Lex Artis ad hoc, to which the actions of a professional must conform, by analysing which it will be possible to verify whether the damage could have been avoided. Finally, the treatment of civil, administrative and criminal health liability will be discussed, as well as the responsibility of public administrations in this respect, the scarce regulation of the matter and the problems that this entails when it comes to going to court, and lastly, mention will be made of the impact on liability due to the pandemic caused by the SARS-CoV-2 pandemic.es_ES
