Resumen :
Tras la aprobación de la Ley 7/2012, de 29 de octubre, de Modificación de la Normativa Tributaria y Presupuestaria para la lucha contra el fraude, se introdujo una nueva Disposición Adicional Decimoctava en la LGT, relativa al cumplimiento de la obligación de información sobre bienes y derechos situados en el extranjero, también conocida como el Modelo 720. El apartado primero de esta DA 18ª establece la obligación para sus titulares de informar sobre, por ejemplo, cuentas financieras abiertas en entidades situadas en el extranjero, valores, títulos, derechos, etc. depositados en el extranjero, y también sobre bienes inmuebles o derechos sobre bienes inmuebles radicados fuera de España. Así es, esta nueva obligación de información conocida como Modelo 720 va a ser nuestro destino, el objetivo principal de nuestro análisis. Un controvertido modelo, por lo difícil de cumplimentar, y cuestionable por el duro régimen sancionador que conlleva errar al cumplimentarlo o no presentarlo en plazo. Esta obligación no nace de la nada sin que el legislador tenga motivo alguno para ello. La lucha contra el fraude ya no se puede contrarrestar desde una perspectiva solo interna, con medidas emanadas de la intuitiva creación legislativa del propio Estado afectado, con destino a evitar que cada vez se recauden menos impuestos por el fraude fiscal existente. Estamos en un mundo cada día más globalizado; economía, información, trabajo, ocio, etc. son actividades que desarrollamos en un marco supranacional y, por ello, los Estados deben aliarse a la hora de producir normativas que ayuden a evitar que existan prácticas elusivas de obligaciones fiscales. En este trabajo se va a realizar un camino previo al destino: el Modelo 720. Tenemos que tener claro qué es fraude de ley y qué es fraude fiscal; definiremos qué son los paraísos fiscales, y especificaremos las medidas antiparaíso existentes; mostraremos lo importante que son, tanto el intercambio de información internacional entre Estados, como las medidas antifraude en la lucha internacional. Finalmente, veremos que, en ocasiones, los Estados han optado por ofrecer amnistías fiscales para poder aflorar bienes ocultos y disponer de más recursos, con las consecuentes críticas recibidas por la opinión pública. Concluiremos poniendo de relieve que esta nueva obligación informativa en España pende de un hilo tal y como la conocemos hoy. La Comisión Europea, previa denuncia en el año 2013 de varios particulares, entre ellos DMS Consulting, ha emitido un Dictamen Motivado a España para que modifique la normativa del Modelo 720. Los argumentos contra esta obligación informativa van desde que es innecesaria porque existen otras formas de acceder a esa información como pedirla a las entidades financieras extranjeras, que su incumplimiento conlleva un durísimo régimen sancionador que no resulta acorde con las sanciones establecidas en el ámbito interno, infinitamente menores; hasta contemplar como muy excesivo que la consecuencia de no presentar o presentar fuera de plazo la declaración sea la consideración de esas rentas como ganancias de patrimonio no justificadas, tributando al tipo general (en ocasiones superior al 50%) y añadiendo una sanción del 150% sobre la cuota resultante, sin olvidar la imprescriptibilidad de estas rentas supuestamente obtenidas en el exterior. Residentes extranjeros en España, y los mismos nacionales, sufren incertidumbre acerca de la presentación o no el Modelo 720, ante la expectativa de que el Estado español tenga que modificar la normativa. Regularizar estas situaciones lleva un coste tremendo, muchas veces superior al valor de la renta o bien declarado. Solo el tiempo nos permitirá ver el desenlace…
After the adoption of Act No. 7/2012 of 29 October, of the Amendment to the Tax Legislation and Budgetary Law for the fight against fraud, the eighteenth Additional Provision in the LGT was added, regarding the compliance of the obligation to inform about goods and rights located abroad, also known as Form 720. Pursuant to the provisions of section one of the eighteenth Additional Provision there is an obligation to inform their holders about, for example, foreign financial accounts, stocks, securities, rights, and so on, held abroad, and about property or rights on property based outside Spain too. So, this new obligation of information known as Form 720 is going to be the main objective of our study. This is a controversial form since it is rather difficult to complete and questionable, due to the severe penalty regulation, if there is any error in completing the form or it arrives out of time. The legislator has had different reasons to create it. We can not fight against fraud from just an internal perspective, with measures originating from the intuitive legislative creation of the concerned State itself, to avoid levying less and less taxes due to the tax fraud. We are living in an increasingly more globalized world; economic, information, work, leisure and so on, they are activities which we develop in a supranational framework, and so that, the States must join together to produce regulations to help avoiding elusive practices of fiscal obligation. In this project, we are going to take a previous way to the destination: The Form 720. We should be clear on what is tax fraud and fraud of law; we are going to define what a tax haven is and specify some existing measures to avoid their effects; we will show the importance of both, the international information exchange between States and other anti-fraud measures in the International fight. Finally, we are going to demonstrate that sometimes the State have no other option than offering tax amnesties to surface hidden goods and to have more resources, with the ensuing criticisms received by the public opinion. To conclude, we will highlight that this new obligation of information in Spain is hanging on a very thin thread, as we know it now. The European Commission, on complaint from some citizen in 2003, among them DMS Consulting, has issued a Reasoned Opinion to Spain to amend its legislation of Form 720. There is a variety of arguments against this obligation of information, such as the fact that it is unnecessary since there are other ways to get this information asking it to the foreign financial authorities, also that they will face a severe penalty system contrary to the penalties set out at the internal level, which are extremely lower, and finally that it is considered very excessive proceeding since the consequence of the no presentation or the presentation out of time will imply that these incomes will be regarded as non-justified capital gains, and they will tax at the general rate (sometimes above 50 percent), and adding a penalty of 150 percent of the resulting quota, and without forgetting the imprescriptibility of these incomes abroad allegedly obtained. Foreign residents in Spain, and nationals themselves, are being directly affected with reference to fill or not the Form 720 or wait for the normative to be changed by the Spanish State. It would be very costly to regularize this situation, many times greater than the value of the income or declared property. Only time will tell us...
